The investigation is based on the question of whether Exxon's internal view of climate change differed from its external communications, and to what extent, if any, Exxon is culpable of misleading the public and/or investors. I'm not sure what environmental laws are at play here, but the business side of the investigation is fair to investigate. However, it appears from what I've read that Exxon internally viewed global warming merely as a potential future outcome (hence, their analysis on it), but not a certain one. And if that's the case, then there shouldn't be any wrong-doing for their advocating publicly that global warming isn't certain (even if they are wrong about it) because their internal and external words/actions are consistent.
I hope that if there is no fraud found, that the groups investigating advertise that finding as loudly as the finding that they are under investigation.
