Purple Line in jeopardy from animal you'll never see

nor probably knew existed before reading this link. Is this shrimp thing special enough to warrant stopping construction of commuter light rail? Seems like the perfect setup of conflicting liberal interests. More trains vs. a creature probably exactly like hundreds of other similar species, except being left handed instead of right or some other silly distinction.

It won't permanently stop construction. From experience, I'm so confident about that I'd bet one or two of my better looking toes. What it will do is complicate construction thus making it much more expensive and it will blow out whatever optimistic schedule the construction company and developers have in place. They will build in engineering controls to lessen/capture/divert runoff from construction, best management practices to avoid wet seasons, and develop mitigation measures to ensure they affect the little crustaceans as little as possible. They will also have to defend the project against one or several whackadoodle groups who will try to legally block the project or demand a costly new study to potentially reroute the rail alignments. Yes, it's frustrating, but that is what will happen.

Not really. In this case, federal and state environmental regulations and laws require the proponent to consider T&E species in their projects. No private company is compelling them to do so. The law is. Out here, the equivalent species is the San Diego Fairy Shrimp (Branchinecta sandiegonensis). It's a guaranteed $$$ pit for developers too.

WADR, I disagree. The gov't DID a report which considered T&E species and THE SHRIMP WASN'T IN IT. Now, the "Rock Creek Conservancy," a 501(3)(c), is threatening to sue them if it's not included. "Fitzgerald" from the original article is the lawyer for the Rock Creek Group.

With all due respect, my point was and is there is no group out there saying

The original study was compelled by public law, not some private entity extorting the developer. The developer and government proponent (subject to the requirements of NEPA if any amount of Federal funding was involved) were not coerced by any group or company to complete the study. It's the law.

What that group can do is take the developer to court picking apart the legally required study to get it thrown out or compel the developer to complete yet another more detailed study thus costing more $$$ and time. Even then though, that second mythical study they would be forced to undertake would be done by a company with no conflict of interest or it would be in danger of being thrown out too. It will slow down the project, but it will not end it if the developer has it's ducks in a row.
