Why does it matter? The buyer is responsible for paying the tax, whether they pay it to the seller or the state. They always have been — and that part is key. The use tax is nothing new. It's been a thing for decades, since way before the advent of the internet. Sellers who have no employees or fixed assets (stores, distribution centers, call centers, etc.) within a state are not required to collect sales tax. It's just the way it is. Always has been. Because states have no recourse or ability to enforce a requirement of those vendors to collect sales tax.

Bottom line is, the buyer has always been responsible for paying sales/use tax, regardless of whether the seller collected it.
So why are there laws requiring brick and mortar businesses to collect sales taxes and remit them to the state/locality? Why the different treatment? We both know why.
it is a matter of nexis, state sales tax from way back were if you were located there you sold stuff you had to collect for the state, the internet retailers have a location somewhere or a warehouse they ship out of and unless it is in the state they are not REQUIRED to collect it as they do not have nexis. The problem is this is based on past times, as of now all vendors should be required to collect on any state they sell into IMO which would make it much easier for the consumer and everyone is on a level playing field. And with states being broke and dying for tax dollars they have gotten much more aggressive on going after companies and consumers for sales tax.

Because the state can put a lien on brick and mortar property... it's easier to collect. Also, the brick and mortar typically only has the one state. Internet sales can touch all 50 and the filing requirements would be absolutely nuts. Keeping track of sales tax would become a full time job. For big outfit like Amazon, they have the ability to do it for relative low cost. For smaller retailers, it's cost prohibitive. That's why.

We want the internet to represent the best parts of capitalism — the closest thing left to a truly free market — and that's not possible if you make prohibitive requirements of the seller. As internet sales grow, and given how strapped state and local governments are for revenue, it will be harder and harder for them to hold the government at bay because they know they are losing huge amounts of money.

I still don't think it matters, the end result is going to be the same. The buyer is responsible for paying the tax. That said, if you want to lobby for a change in the law in order to get etailers to collect it, you have to get out in front of it by telling everyone exactly what I've been saying all throughout this thread... It is NOT a new tax. People have to understand they are liable for the use tax on all of their internet purchases already and if they haven't been paying it, they are guilty of tax evasion.

The biggest opposition isn't so much from the sellers, contrary to what you may believe. The biggest backlash is from buyers who think the government is trying to create a new tax for then to have to pay. They believe internet purchases are tax free, and that is simply not true.
I don't care if you're a Democrat or a Republican... if you refuse to consider alternatives to the two parties, you support the Status Quo and you are a major part of the problem.

Some states have laws requiring internet retailers collect and remit sales tax. Amazon already does that in every state that has a sales tax, regardless of whether there is a law requiring it.
