it is a matter of nexis, state sales tax from way back were if you were located there you sold stuff you had to collect for the state, the internet retailers have a location somewhere or a warehouse they ship out of and unless it is in the state they are not REQUIRED to collect it as they do not have nexis. The problem is this is based on past times, as of now all vendors should be required to collect on any state they sell into IMO which would make it much easier for the consumer and everyone is on a level playing field. And with states being broke and dying for tax dollars they have gotten much more aggressive on going after companies and consumers for sales tax.133743Hokie wrote:So why are there laws requiring brick and mortar businesses to collect sales taxes and remit them to the state/locality? Sellers who have no employees or fixed assets (stores, distribution centers, call centers, etc.) within a state are not required to collect sales tax. It's just the way it is. Always has been. And recently states have taken to adding a line for use tax to your state income tax return, which you are required to sign under penalty of perjury that you are filing an accurate return. If you check the box indicating no use tax is due and the state later finds you bought a bunch of stuff on the internet without paying sales tax, they will be able to nail your ass to the wall, if they choose to do so.
Oh, I know why. Because it would then make their products look more expensive and more in line with brick and mortar competitors. That and the fact that their lobby has lined the pockets of state and federal legislators.
Bottom line is, the buyer has always been responsible for paying sales/use tax, regardless of whether the seller collected it.

Major retailers have brick and mortar stores everywhere in every state and locality, yet they are able to collect sales taxes.Hokie CPA wrote:Because the state can put a lien on brick and mortar property... it's easier to collect. We want the internet to represent the best parts of capitalism — the closest thing left to a truly free market — and that's not possible if you make prohibitive requirements of the seller. In the end, paying these taxes has always been the buyer's responsibility, so let the buyer take care if it. He can do so by writing a single number on his state tax return each year. It doesn't get any easier than that.
Your belief that we want the internet to be the best parts of capitalism is just that, your belief, nothing more. There is nothing magical, mystical or pure about e-tail. It's just another way of offering a product. Nothing more, nothing less. The reality is their lobbyists got out in front of this issue early and have been able to fight off sales tax collection, despite the huge contradiction and special treatment. As internet sales grow, and given how strapped state and local governments are for revenue, it will be harder and harder for them to hold the government at bay because they know they are losing huge amounts of money.

I still don't think it matters, the end result is going to be the same. The buyer is responsible for paying the tax. That said, if you want to lobby for a change in the law in order to get etailers to collect it, you have to get out in front of it by telling everyone exactly what I've been saying all throughout this thread... It is NOT a new tax. People have to understand they are liable for the use tax on all of their internet purchases already and if they haven't been paying it, they are guilty of tax evasion.
The biggest opposition isn't so much from the sellers, contrary to what you may believe. The biggest backlash is from buyers who think the government is trying to create a new tax for then to have to pay. They believe internet purchases are tax free, and that is simply not true.

Some states have laws requiring internet retailers collect and remit sales tax. LOL, nope. Stuff like this doesn't upset a man. It didn't upset generations of men before who were blunt and genuine in their language. Beating around the bush and using non-offensive wishy-washy language is what chicks do. Politicians started using wishy washy bullshit when women became a voting block (around the same time as the welfare state...not a coincidence).
