I never really understood how the good cause rule makes sense. In the gun control battle, that seems like the ultimate "the bad guys aren't going to follow the rule anyway" scenario.

This ruling is fallout from the case where DC's prohibition on carry was struck down. The ruling is pretty damn clear that they have to allow carry. Options for DC are:

1. Request an En Banc (entire DC CA panel review of case) - this is where the MD case was overturned I believe. Hope for temporary stay. I'm told this is rare for the DC CA for what it's worth.

2. Appeal to Supreme Court. Hope for temporary stay.

3. Start giving out permits to folks who aren't prohibited from owning a gun after they jump through the DC circus routine you need to do to otherwise get a license.

4. Allow open carry (with it strongly implied that you will get you shirt jacked up by every cop you pass). This is is antithetical to every argument they've made previously, though.

If you're now aware, DC's law is patterned after MD. If SCOTUS affirms this ruling, MD will be shall issue.

Things often don't make sense in liberal-ville.. especially gun laws.. every once in a while we get lucky and common sense enters the room via appeal

It makes perfect sense. These laws are holdovers from the Jim Crow era. In Maryland, defense of your child's life is not justification for a concealed carry permit, but - I shirt you not - defense of a $200 deposit from your small business is. The irony is that in MD, defense of property is not an authorized use of lethal force.

Back the point, though. The laws were used to prevent uppity negroes from carrying around guns. They restricted it to business owners, politicians, or people with a "justifiable need" (IE - the sheriff makes sure you're the right color). Today, the laws are used to restrict access to only the political class.

The reason these stupid arguments still work is because leftist judges allow an *intermediate scrutiny* (for a right which says "shall not be infringed") - which only requires the state show that they have an "important government objective" in reducing gun violence. So they states just come out and say "think of the chil'ren!" and the leftist judges are fine with it.

Conservative justices have been cautious to apply strict scrutiny because they're afraid of rocking the boat too much. Not even Heller used strict scrutiny.

nope. DC will be forced to be different. Maryland is in the 4th circuit. The 4th circuit held differently.

This is the DC Circuit, which upheld Heller 1 en banc.

DC will not be able to defacto ban concealed carry.

More great news. DC Circuit denied en banc!

Two options possible from here:

1. DC doesn't appeal. Permits to carry a concealed firearm are issued to anyone not restricted from owning a firearm.
2. DC appeals to the Supreme Court...and risks making shall issue the law of the land.
