Remember when libs here were squealing about Cliven Bundy?

Post by UpstateSCHokie »

I recall a lot of the more unhinged libs (grapeape, Uprising, etc.) were all over the board screaming about how the BLM was justified in its actions against Bundy. They loved the heavy handed tactics of the BLM because it was Obama's government, and in their eyes it could do no wrong.

Would be interesting to hear what they have to say about this story, but strangely they all ran away after Trump won.

REPORT: Fed Agency Committed ‘Militaristic’ Operation Against Nevada Rancher
Tim Pearce
5:16 PM 12/18/2017

An investigation into the Bureau of Land Management’s (BLM) handling of the 2014 Nevada standoff with rancher Cliven Bundy revealed “incredible bias,” widespread misconduct and likely illegal actions by the BLM.

Prosecutors shared the report with the Bundys’ defense attorneys, prompting a petition to Judge Gloria Navarro for a mistrial, or for the case to be dismissed altogether, The Oregonian reports. Navarro’s judgement is expected to come down Wednesday.

“It’s time for our men to go home and start making a living for their families,” Carol Bundy, Cliven Bundy’s wife, told The Daily Caller News Foundation. “We’re two years behind. We’ve got a lot of catching up to do.”

The investigation’s report, made by BLM Special Agent Larry Wooten and addressed to the Department of Justice, was publicized last week after Washington state Rep. Matt Shea posted it on his Facebook page, according to The Wall Street Journal.

Wooten’s 18-page report discussed some of what he witnessed during his three-year investigation, such as a BLM agent’s “kill list” featuring people who had committed suicide while under investigation by the agency, BLM agents and officials referring to the Bundys as “retards” and “douche bags,” agents bragging about “grinding” a Bundy family member’s face into gravel, and lead prosecutor and Nevada’s acting U.S. Attorney Steve Myhre’s “preferred ignorance” of investigation details that would benefit the Bundys’ defense case.

Former Special Agent Dan Love, who was in charge of impounding Cliven Bundy’s cattle in 2014, conducted “the most intrusive, oppressive, large scale and militaristic trespass cattle impound possible” against Bundy’s ranch against the direction of the U.S. attorney’s office, according to Wooten. The Bundys’ defense strategy accuses the BLM of using overly-aggressive and threatening tactics.

Navarro has ruled that Myhre’s prosecution team has committed numerous Brady Act violations failing to turn over exculpatory evidence, evidence that may exonerate the Bundys. In light of the violations and Wooten’s memo, Navarro sent the jury home last week as she considers ruling a mistrial or dismissing the case.

Wooten was removed from his position in the investigation in February by Myhre and his notes and case materials were taken. Assistant Special Agent Kent Klemen carried out Myhre’s order to gather Wooten’s data in what Wooten called a “raid” on his office.

Myhre declined TheDCNF’s request for comment.

Unsealed Court Docs Show How Prosecutors Tried To Rig Bundy Trial
Tim Pearce
2:34 PM 12/29/2017

Unsealed court documents detail how the team of prosecutors tasked with convicting Cliven Bundy and his sons of crimes relating to a 2014 armed standoff failed to turn over potential exculpatory evidence to the court, The Oregonian reports.

The Bundys’ case ended in a mistrial Dec. 20 after Judge Gloria Navarro ruled that prosecutors violated the civil rights of the defendants by withholding evidence supporting the Bundys’ case. Navarro is considering dismissing the case “with prejudice” and blocking prosecutors from retrying the case. Her decision will come Jan. 8, according to The New York Times.

“There were approximately 3,000 pages that were provided to us only after we started trial,” Bundy lawyer Bret D. Whipple told TheNYT. “I personally have never seen anything like this, especially in a case of such importance.”

Those 3,000 pages include the Bundys’ requests for multiple federal assessments that showed the Bundy family was likely not dangerous. Prosecutors called the requests part of a “long list of frivolous and vexatious pleadings,” until a government witness, under cross examination, revealed knowledge of the assessments in court, The Oregonian reports.

Defense attorney’s asked federal prosecutors to hand over Inspector General reports on Bureau of Land Management (BLM) agent Dan Love, who directed the BLM raid on the Bundy ranch to seize the family’s cattle over decades of unpaid grazing fees. Love was fired from the agency in September for corruption and unethical behavior.

Prosecutors had dismissed the allegations and investigations of Love as an “urban legend,” but ended up handing over 500 pages worth of reports on Love in December, according to The Oregonian.

The Bundys’ lawyers made two requests to Navarro for a special “discovery monitor” to ensure that all relevant documents were being turned over by the prosecution. Both requests were denied. Attorney General Jeff Sessions, however, launched an investigation into prosecutorial misconduct after the mistrial.

Given the amount of time the media spent on this story when they could spin it as "an old white racist guy breaking the law," you'd think this dismissal would be HUGE news on CNN, NBC, etc.

BREAKING: Charges Against Rancher Cliven Bundy and 3 Others Dismissed – Judge Cites “Flagrant Prosecutorial Misconduct”
by Cristina Laila

A federal judge has dropped all charges against Rancher Cliven Bundy and three others, Fox News reported.

Fox News reported:
A federal judge dismissed all charged against rancher Cliven Bundy and three others

U.S. District Judge Gloria Navarro cited “flagrant prosecutorial misconduct” in her decision to dismiss all charges against rancher Cliven Bundy, two of his sons and another person.

The embarrassment a federal judge dealt to government prosecutors last month in the Cliven Bundy case could be set to resume Monday, at a hearing to determine whether the cattle rancher who became a folk hero long before he beat the feds can be retried.

U.S. District Judge Gloria Navarro on Dec. 20 declared a mistrial in the high-profile case. It was only the latest, stunning development in the saga of the Nevada rancher, and served as a repudiation of the federal government. Navarro accused prosecutors of willfully withholding evidence from Bundy’s lawyers, in violation of the federal Brady rule.

The Brady rule, named after the landmark 1963 Supreme Court case known as Brady v. Maryland, holds that failure to disclose such evidence violates a defendant’s right to due process.
The 71-year-old Cliven Bundy battled the federal government for years. The most recent battle in 2014 was known as the Bundy standoff.

In 2014 federal authorities moved in to impound cattle that was grazing on government land.

Cliven Bundy, along with his sons Ammon and Ryan were charged with felonies, including conspiracy, assault on a federal officer and using a firearm in a violent crime.

The men faced many years in prison, Fox News reported.
