Honest question, what exactly is under Mueller's "umbrella"? I presumed that it was to find out whether or not there was Russian interference in the 2016 Presidential election. That would be an intelligence investigation. It wasn't to find out if there was interference, that was already known. It was to determine if there was any assistance given to the Russians conducting the interference, and also to investigate any links between the Trump campaign and Russia government personnel. And I didn't say a criminal investigation belongs under DOJ, that's not accurate at all. And the mandate specifically included this:

So again, the investigation is an intelligence investigation. He is allowed to pursue a criminal investigation if it arises from someone breaking the law as a result of his intelligence investigation, i.e obstruction of justice, destruction of evidence, perjury, or witness intimidation. He is not performing a criminal investigation.
