Cabbie gets arrested.
I guess it is extortion. And as we aren't a civil law country, I suppose the "victims" poor actions are beside the point.

If it had been any other city I might agree with the "celebrity" in question. But to arrest a cabbie for taking pictures of a drunk chick, flashing her junk, in the city of New Orleans is a goddamned travesty! God help those poor schmucks at next year's Mardi Gras parade if the cops decide to enforce this one across the board!

She was not in public. I'm not sure he had such a right to take it - she did not give him permission.
But yeah, I kind of hope he gets off for some reason.

Who kisses a cab driver?! She has problems.
Taking pictures of someone in that altered state is morally wrong (so is not keeping your skirt down if she was being salacious <purposefully>), but the real actionable WRONG here is attempting to extort cash from her for the pics of her fancy.
Never get drunk with anyone you wouldn't trust your social security number to.

I would argue that he was merely presenting relevant evidence for his battery civil suit, and offering a settlement.

I could go two ways on this.
1) If she's not in public, she's in his property. Certainly if you're in my house (or car), I have a right to take any picture of you that I could on the street.
2) One argument anti-smoking-in-restaurants use is that since the establishment is open to the public, it has to be treated as public space for certain purposes and people have the right to breath smokeless air. I don't agree with this argument, but surely this would apply to a taxi as well.
